1. Agreement to Terms

By accessing or using GEAR VPN ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

GEAR VPN provides a Virtual Private Network (VPN) service that encrypts your internet connection and protects your online privacy. Our Service is available through our iOS application and includes:

  • Encrypted internet connection
  • Access to global server network
  • Privacy protection features
  • Customer support services

3. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have your parent or legal guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

To use certain features of the Service, you may be required to create an account. You agree to:

6. Subscription and Payment

6.1 Subscription Plans

GEAR VPN offers various subscription plans. Subscription details, including pricing and features, are displayed in the app and on our website.

6.2 Payment

Payments are processed through Apple's App Store. By subscribing, you authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6.3 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You can manage your subscription through your Apple ID account settings.

7. Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of your current billing period. Refund requests should be directed to Apple, as they process all payments for iOS apps.

8. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be:

  • Always available or uninterrupted
  • Free from errors or bugs
  • Secure or free from viruses
  • Available in all geographic locations

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by GEAR VPN and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEAR VPN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar harmful components
  • Any errors or omissions in any content

13. Indemnification

You agree to indemnify, defend, and hold harmless GEAR VPN and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, expenses, or fees arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GEAR VPN operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration association, except where prohibited by law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and GEAR VPN regarding the Service and supersede all prior agreements and understandings.
